1.3 This TOS is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates intermediaries and service providers to make publicly available the terms and conditions governing access to or use of their online platforms.
1.4 Accordingly, this TOS governs all access to and use of the www.GiftedToAll.com online platform (the “Website” or “e-Portal”) operated by GiftedToAll India Ltd., including all related content, functionalities, and services offered through it.

2. PENALTIES IN LAW
2.1 Tampering with Computer Source Documents
As per Section 65 of the Information Technology Act, 2000, any person who knowingly or intentionally conceals, destroys, or alters any computer source code required to be maintained by law for any computer, computer program, system, or network shall be punishable with imprisonment up to three (3) years, or with a fine up to ₹2,00,000 (Rupees Two Lakhs Only), or with both.
2.2 Hacking with Computer Systems
Under Section 66 of the Information Technology Act, 2000, any person who, with the intent to cause or knowing that he is likely to cause wrongful loss or damage to the public or any person, destroys, deletes, alters, or diminishes the value or utility of information residing in a computer resource, or affects it injuriously by any means, shall be punishable with imprisonment up to three (3) years, or with a fine up to ₹1,00,000 (Rupees One Lakh Only), or with both.
2.3 Receiving Stolen Computer Data or Devices
According to Section 66B of the Information Technology Act, 2000, any person who dishonestly receives or retains any stolen computer resource or communication device, knowing or having reason to believe it to be stolen, shall be punishable with imprisonment up to three (3) years, or with a fine up to ₹1,00,000 (Rupees One Lakh Only), or with both.
2.4 Publishing or Transmitting Obscene Information
In accordance with Section 67 of the Information Technology Act, 2000, any person who publishes or transmits, or causes to be published or transmitted, any obscene or lascivious material in electronic form shall be punishable with imprisonment up to two (2) years, and with a fine up to ₹2,000 (Rupees Two Thousand Only), or with both.
In the event of a subsequent conviction, the punishment may extend to imprisonment up to five (5) years and a fine up to ₹2,000 (Rupees Two Thousand Only), as per Section 292 of the Indian Penal Code (IPC).
2.5 Sending Offensive or Publishing False Information
Pursuant to Section 66A of the Information Technology Act, 2000, any person who sends, by means of a computer resource or communication device, any information that is grossly offensive, menacing, or false with intent to cause annoyance, inconvenience, danger, insult, or harm, shall be punishable with imprisonment up to three (3) years, and with a fine as determined by the competent court of law.
3. DEFINITION OF TERMS
3.1 The terms “We,” “Our,” “Us,” or “Company” refer to GiftedToAll India Ltd., a company duly incorporated under the applicable laws of India, operating and managing the digital gifting and promotional platform www.GiftedToAll.com, along with all its associated sub-domains, mobile applications, and related digital services.
3.2 The terms “You” or “Your” refer to any visitor, user, shopper, customer, or authorized representative who accesses, browses, or transacts on the Website, thereby agreeing to comply with this Terms of Use and other related policies of the Company.
3.3 The terms “E-Portal,” “Online Store,” “Storefront,” “Website,” “E-Commerce Platform,” “E-Store,” “Site,” or any similar expressions collectively denote the official online platform owned and operated by GiftedToAll India Ltd., which enables users to browse, purchase, redeem, or interact with the Company’s products, services, and digital offerings.

- GiftedToAll voucher codes can be purchased only through the official GiftedToAll India Ltd. e-Portal. These vouchers are not valid or usable on any other website or platform.
- GiftedToAll vouchers are provided complimentary as part of promotional or reward programs. Neither GiftedToAll India Ltd. nor its Sales Partners accept or have accepted any monetary consideration from customers for their issuance.
- Vouchers are non-transferable and cannot be resold to any third party. They may be redeemed only by the customers to whom they were originally issued.
4.1 AGE LIMITS
4.1.1 The e-Portal is an e-commerce platform where monetary transactions take place. Access to and use of the Website is therefore restricted to individuals of legal majority age as defined by the Government of India and the applicable State laws.

4A. ACCEPTANCE OF TERMS OF SERVICE
4A.1 This Terms of Service (“TOS”) is a legally binding agreement between you (the user) and GiftedToAll India Ltd. governing your access to and use of the www.GiftedToAll.com e-Portal, including all content, features, functionality, and services offered through it—whether as a guest or a registered user.
4A.2 By accessing, browsing, or using the e-Portal—or by clicking “Accept” or “Agree” where prompted—you acknowledge and consent to be bound by this TOS and the Privacy Policy, both of which are incorporated herein by reference.
4A.3 If you do not agree to these Terms of Use or the Privacy Policy, you must not access or use the Website or any of its services.
4A.4 By continuing to use the e-Portal, you confirm that you have read, understood, and accepted this TOS, along with all other related policies (including the Privacy Policy and Sales/Service Policies). Users must review and comply with such third parties’ respective terms and conditions in addition to the Company’s stated Terms and Conditions.
5. INTELLECTUAL PROPERTY RIGHTS
5.1 The www.GiftedToAll.com e-Portal and its contents — including but not limited to text, images, graphics, audio, video, software, user interface design, source code, layout, data compilations, and overall look-and-feel — are the exclusive property of GiftedToAll India Ltd., its licensors, and authorized content providers.
All such materials are protected under applicable Indian and international laws, including the Copyright Act 1957, the Trademarks Act 1999, the Patents Act 1970, and laws relating to Trade Secrets and Proprietary Rights.

Except as expressly permitted herein, you shall not modify, reproduce, distribute, create derivative works from, publicly display, perform, republish, download, store, or transmit any material from the e-Portal.

5.2.2 Automatic caching of data by your web browser to enhance user experience.

5.2.4 Downloading a single copy of any official GiftedToAll desktop or mobile application for personal use, subject to the End User License Agreement (EULA) applicable to such application.
5.2.5 Use of embedded social-media features provided on the Website, in accordance with both this TOS and the respective platform’s usage norms.
5.3 YOU MUST NOT:
5.3.1 Alter, edit, or manipulate any texts, images, animations, audio, or video from the e-Portal.
5.3.2 Remove, delete, or modify any logo, watermark, or notice of copyright, trademark, or proprietary rights.
5.3.3 Use or access any portion of the e-Portal or its content for commercial, resale, or competitive purposes.
5.4 Any unauthorized copying, modification, or distribution of Website content constitutes a breach of this TOS. Upon such breach, your right to use the Website shall terminate immediately, and at the Company’s discretion you must return or permanently destroy all copied or derived materials.

5A. TRADEMARKS
5A.1 The name “GiftedToAll India Ltd.”, its logo, design elements, brand colors, and tagline are registered or unregistered trademarks and the exclusive property of the Company.
5A.2 All other product names, brand marks, logos, designs, and slogans displayed on the e-Portal are the property of their respective owners, licensors, or service providers, and are used for identification and reference purposes only.
5A.3 You are strictly prohibited from using, copying, reproducing, displaying, or distributing any trademark or service mark of the Company or of third parties without prior written authorization from the respective rights holder.
Unauthorized use may result in legal action under the Trademarks Act 1999 and related statutes.
5B. PROHIBITED USES
You are granted access to the e-Portal subject to compliance with this TOS. By using the Website, you agree not to engage in any activity that violates law, infringes rights, or disrupts the secure operation of the platform.
You are strictly prohibited from:

5B.5 Engaging in behavior that restricts or interferes with others’ use or enjoyment of the e-Portal, or that could harm the Company, its reputation, or its users.
5B.6 Performing actions that may damage, disable, overburden, or impair the Website’s infrastructure or hinder other users’ real-time interactions.
5B.7 Employing any robot, spider, crawler, scraper, or automated means to access, monitor, or extract data from the Website.
5B.8 Using any manual or automated process to copy or monitor Website content or user activity for malicious or competitive purposes without prior authorization.
5B.9 Introducing or attaching any third-party device, software, or routine designed to interfere with or alter the Website’s operation or functionality.

6.2 User Obligation to Review
As a registered or guest user of the e-Portal, you agree to periodically review this TOS and any accompanying updates. Your continued access or use of the e-Portal following such changes shall be deemed as your acceptance and agreement to the modified Terms of Service.
6.3 Scope of Changes

7.2 This Terms of Service (TOS), along with all associated policies, contracts, and user agreements, shall be governed by and construed in accordance with the prevailing laws of India, including but not limited to the Information Technology Act, 2000, the Indian Contract Act, 1872, the Indian Penal Code, 1860, and other applicable Central, State, District, and Local Authority laws and regulations as may be in force from time to time.
7.3 In the event of any claim, dispute, or legal proceeding arising out of or in connection with this TOS, the Website, or any services rendered by the Company, you expressly agree that such matter shall be subject to the exclusive jurisdiction of the competent courts at Rajkot, Gujarat, India.
Accordingly, you agree not to initiate, pursue, or participate in any legal action or proceeding against the Company or its affiliates in any jurisdiction other than Rajkot, Gujarat (India).
7.4 Both parties further agree to abide by the lawful orders, directions, and decisions of the courts situated within this prescribed jurisdiction, and all disputes shall be resolved in accordance with the laws and judicial process applicable within the territory of India.
8. SITE MALFUNCTIONING
8.1 The www.GiftedToAll.com e-Portal is hosted and operated using third-party web hosting and cloud infrastructure services. While every reasonable measure is taken to ensure uninterrupted and high-quality service, the continuity, uptime, and performance of such third-party systems remain beyond the Company’s direct control.
In the event of any malfunction, service interruption, delay, or denial of access caused by such third-party providers, you may inform the Company through the designated support channels. However, the Company shall not be held liable for any resulting inconvenience, delay, or loss, nor shall any legal claim or action be maintainable on such grounds.
8.2 The Company recognizes that some users or external entities may attempt to compromise the functioning of the e-Portal through unauthorized, unethical, or malicious activities, including but not limited to spamming, code injection, hacking, phishing, denial-of-service attacks, or virus transmission.
Such actions may disrupt Website functionality, compromise data integrity, or endanger user security.
Hereby, you agree to the following:
8.3 If any malicious or suspicious activity is detected from your account, IP address, or device that indicates a potential violation of the Information Technology Act, 2000 (Sections 43A or 66) or any other applicable law, the Company reserves the right to:
- Restrict, suspend, or terminate your access to the Website immediately;
- Preserve and disclose digital evidence to law enforcement agencies; and
- Cooperate fully with governmental or judicial authorities to initiate legal or criminal action against you, with or without prior notice.
8.4 Users are advised to maintain updated antivirus and firewall protections and to refrain from engaging in any digital activity that could endanger the Website’s operation, data integrity, or user privacy.
9. LIMITATION OF LIABILITY

Explanation
While the Company exercises due diligence in providing secure and reliable digital services, you acknowledge and agree that certain factors are beyond its reasonable control, including but not limited to:
9.1 Unforeseen interruptions or delays that may occur while accessing various online services.
9.2 Occasional bugs, system errors, or malicious cyber-attacks that may affect the stability or security of the e-Portal.
9.3 High traffic volumes during promotional or holiday sales that may temporarily reduce site performance or availability.
9.4 Disputes or warranty issues arising from Sales Partner products or third-party providers, despite the clarity of their own published terms.
9.5 Misunderstandings regarding services, digital voucher applicability, or third-party integrations.
9.6 Events of force majeure, including natural disasters, power failures, pandemics, or other human-made disruptions that may impact on-site or cloud-based operations.
User Acknowledgment
9.7 In case of any concern or grievance, you agree to first contact our customer-service team for clarification or resolution. The Company endeavours to respond promptly and maintain long-term, transparent relationships with its valued users.
9.8 If a reported issue lies beyond the Company’s reasonable capacity or jurisdiction to resolve, you acknowledge that no refund, compensation, or reimbursement—including for damages, attorney fees, or court costs—shall be claimed against the Company, its affiliates, or partners.
10. DISCLAIMER OF WARRANTY
10.1 GiftedToAll India Ltd. is not the manufacturer, producer, or originator of the products displayed on the e-Portal. The Company functions solely as a digital marketplace and facilitator connecting customers with verified brands, manufacturers, and authorized Sales Partners.
Accordingly, the Company does not provide or extend any warranties—express or implied—relating to product manufacturing defects, performance issues, accidental damages, or usage outcomes.
10.2 The Company may, at its discretion, guide or redirect customers to the respective original manufacturers, brand owners, or Sales Partners (as defined under the Sales Partner Agreement) for any claims, warranty support, or product-related grievances.
Users are required to adhere to the warranty, return, and service policies set forth by the respective manufacturer or Sales Partner for the purchased product(s).
10.3 The Company’s packing, shipment, and payment processing services are executed through authorized third-party service providers, including but not limited to shipping carriers, payment gateways, insurance agencies, and banking institutions. These service providers operate under their independent terms, policies, and regulatory obligations.
10.4 Consequently, the Company’s liability is limited strictly to the extent of its direct role as an intermediary platform. The Company shall not be held responsible or legally liable for any delay, discontinuation, service lapse, financial loss, or damage arising from the actions, omissions, or failures of such third-party service providers.
Users expressly agree not to raise claims or initiate legal proceedings against the Company for any issue that originates from a third-party provider’s operations or negligence.
10.5 Whenever the e-Portal integrates or utilizes any third-party service, software, or digital interface, such integration is subject to the terms and conditions (T&C) and privacy policies of those external service providers.

11. INDEMNIFICATION

This clause ensures that you, as a user, understand and accept your legal responsibilities in such circumstances.
11.1 User’s Obligation to Indemnify
You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, service providers, and their respective directors, officers, employees, agents, contractors, successors, and assigns from and against any and all claims, actions, proceedings, damages, liabilities, losses, judgments, awards, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with:
11.1.a User-Generated Content (UGC) — any material, data, comments, or content uploaded, shared, or posted by you on the e-Portal that violates intellectual property, privacy, or content regulations.
11.1.b Sales Partner Activities — any product-related claims, disputes, or legal actions initiated against the Company arising from products or services provided or promoted by you as a registered Sales Partner.
11.1.c Transactional Errors — any mistake, misrepresentation, or fraudulent activity committed by you during the course of monetary or digital transactions on the e-Portal.
11.1.d Data-Related Losses — any accidental, negligent, or intentional act by you or your associated personnel that results in data loss, corruption, or misuse affecting the Company, its Sales Partners, or other users.
11.2 Cooperation and Support
While the Company shall exercise all reasonable measures to defend itself against any such claims or legal proceedings, you agree to cooperate in good faith with the Company’s legal team, representatives, and external counsel during the process.
Your moral and active participation in providing clarifications, evidence, or testimony—if reasonably required—is considered an essential component of this indemnification obligation.
11.3 Scope of Indemnification
This indemnification extends to all categories of stakeholders, including but not limited to:
- Registered and guest users of the e-Portal,
- Authorized Sales Partners,
- Third-party service providers (such as payment gateways and logistics partners), and
- Any entity interacting with or benefiting from the Website’s ecosystem.
11.4 General Indemnity Clause
By using the Website, you expressly agree to:
Defend, indemnify, and hold harmless GiftedToAll India Ltd., its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal and attorney fees) arising out of or relating to:
- Your violation or breach of these Terms of Service or the User Agreement;
- Your misuse of the e-Portal, its content, or associated services beyond what is expressly authorized; or
Your use or reliance on any information obtained through the Website
12. TERMINATION OF SERVICE

Your continued use of the Website constitutes acceptance of these terms; conversely, your disagreement or discontinuation signifies withdrawal from the contractual relationship established herein.
